Terms of Use

1. Acceptance

By downloading or using the Faktum application ("App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. We may update these Terms; continued use after a change constitutes acceptance.

2. Description of the service

Faktum is an AI-assisted fact-checking tool that listens to live conversations, transcribes speech, and attempts to verify factual claims against publicly available sources. The App returns verdicts (Supported, Contested, Contradicted, Counterpoint) with citations to help users evaluate claims.

Faktum is a research and reference tool. It is not an authoritative fact-checking service, a legal determination, or a replacement for professional judgment.

3. Verdict accuracy — no warranty

AI-generated verdicts may be incorrect, incomplete, out-of-date, or missing relevant context. Sources cited by the App are retrieved from the public web and are not independently verified by us. Specific limitations include:

• Claims that are time-sensitive may receive verdicts based on outdated information.
• Contested topics with genuine scientific or political disagreement may not reflect the full range of expert opinion.
• Colloquial, idiomatic, or highly context-dependent statements may be misclassified.
• Claims in languages other than English may have lower accuracy due to source availability.

Always verify important claims from primary sources before acting on them. Faktum shows its work — the cited sources are provided precisely so you can judge the evidence yourself.

4. Recording consent — your obligation

Laws governing the recording of conversations differ by country, state, and context. Using Faktum in a meeting or conversation may constitute recording under applicable law. You are solely responsible for:

• Determining the recording and consent laws applicable to your jurisdiction and use case.
• Obtaining any required consent from participants before using Faktum in their presence.
• Disclosing that an AI tool is listening, where legally or ethically required.

Faktum provides a visible on-screen indicator whenever the microphone is active, and displays a consent reminder before your first session. These design features do not constitute legal advice and do not relieve you of your legal obligations.

5. Acceptable use

You agree not to use Faktum to:

• Record or intercept communications without lawful authority or required consent.
• Harass, intimidate, or deceive any person.
• Circumvent or test the security or rate-limiting of our services.
• Use the App in any manner that violates applicable law.
• Resell, sublicense, or commercially exploit the App or its outputs without our written consent.

We reserve the right to suspend access for violations.

6. Subscriptions and billing

Faktum offers a free tier and a paid Pro subscription. Subscriptions are billed through Apple's App Store and are subject to Apple's standard end-user license agreement and App Store terms.

• Free tier: Unlimited recording and 1 fact-checked hour per month at no charge.
• Pro (monthly): €14.99 per month. Auto-renews monthly until cancelled.
• Pro (annual): €149.99 per year (approximately €12.50/month). Auto-renews annually until cancelled.
• Free trial: New users receive a 7-day free trial of Pro. Billing begins on day 8 unless cancelled before the trial ends. No payment information is required to start a trial.

Cancellation, refunds, and billing disputes are managed through Apple's App Store. We have no access to your payment details.

Prices are displayed in EUR and include applicable VAT where required. Prices may vary by region as determined by Apple's App Store pricing.

7. Intellectual property

The Faktum application, its design, branding, and underlying software are owned by Faktum and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App on your Apple devices, subject to these Terms and Apple's standard EULA.

Session summaries, transcripts, and exports generated from your own conversations remain your content. You grant us no rights over that content beyond what is necessary to provide the service (processing live audio to return verdicts).

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VERDICTS ARE ACCURATE, COMPLETE, OR LEGALLY RELIABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits liability that cannot be excluded under applicable mandatory law (including consumer protection laws in the EU/EEA).

10. Governing law and disputes

These Terms are governed by Austrian law. For users in the EU/EEA, mandatory consumer protection provisions of your country of residence continue to apply. Disputes that cannot be resolved informally may be referred to the competent courts in Vienna, Austria, or to an EU online dispute resolution platform at ec.europa.eu/consumers/odr.
